In recent years, digital assets and cryptocurrencies (Bitcoin, Ethereum, USDT, etc.) have become a major wealth accumulation tool for global investors. Turkey has emerged as a premier destination for investors seeking to convert these assets into tangible, high-yield traditional investments such as real estate.
However, using digital assets to acquire property in Turkey is governed by specific legal procedures and financial regulations.
Legal Framework & Regulatory Principles
Pursuant to the "Regulation on the Disuse of Crypto Assets in Payments" published by the Central Bank of the Republic of Turkey (CBRT), direct payments using cryptocurrencies or the direct utilization of crypto assets as a payment instrument within Turkey are strictly prohibited.
Under this framework:
- Property transactions cannot be paid via direct wallet-to-wallet crypto transfers.
- In official title deed registries and sales contracts, transaction amounts must be documented exclusively in Turkish Lira (TRY) or legally compliant foreign currency.
- All financial transactions must be conducted through licensed banking channels.
How Does the Legal Liquidation Process Work?
Within the framework established by the Capital Markets Board (SPK) and the Financial Crimes Investigation Board (MASAK), the step-by-step property acquisition process for crypto holders works as follows:
- Setting Up Legal Bank & Exchange Accounts
The investor (after obtaining a Tax Identification Number if foreign) opens a current account at a BRSA-licensed Turkish bank. Simultaneously, a personal account is established on a licensed, auditable crypto exchange platform operating in Turkey. - Asset Transfer & Conversion to FIAT Currency
The investor transfers crypto from their global wallet to their personal Turkish exchange account. Here, digital assets are converted into fiat currency (TRY, USD, or EUR). All transactions remain strictly within accounts owned by the investor. - Bank Transfer & Foreign Exchange Purchase Certificate (DAB)
The most critical phase for real estate purchases—especially for foreign nationals applying for citizenship or residence—is obtaining the Foreign Exchange Purchase Certificate (DAB) :- Corporate / Developer Sales: Funds transferred from the exchange to the investor's bank account are remitted to the developer. The developer issues the DAB through its bank via the Central Bank.
- Private / Secondary Market Sales: Since banks cannot issue a DAB for funds withdrawn directly in TRY, assets are transferred in foreign currency from the exchange to the investor's bank account. The currency conversion is then performed by the bank branch to issue the DAB in the buyer's name.
- Title Deed Transfer & Finalization
With official bank receipts and the DAB certificate submitted to the Land Registry Office, the official transfer of ownership and title deed registration is finalized smoothly.
